1. Introduction and Acceptance of Terms
Welcome to CareerCred, accessible at careercred.io (the “Service”). This document outlines the legal terms and conditions that govern your use of our Service. When you access or use the CareerCred website or app, you are agreeing to be bound by these Terms of Service. This is a legally binding agreement between you, the individual using our Service (“User” or “you”), and CareerCred. If you don’t agree with any part of these terms, then you shouldn’t use the Service.
CareerCred is a private career vault: it helps you capture your professional accomplishments (“wins”) as they happen, whether entered in the app or emailed to us, and uses AI to help organize that content and generate career assets like post starters. Your continued use of the Service means you accept these terms, and any updates we might make to them.
2. Account Registration and Security
2.1 Account Creation
To use CareerCred, you’ll need to create an account using your email address. We use passwordless sign-in: instead of a password, we email you a one-time “magic link” each time you sign in. You must provide accurate, complete, and current information during registration. We reserve the right to refuse registration or cancel an account at our discretion.
2.2 Account Responsibilities
Because sign-in works through your email address, access to your email inbox effectively controls access to your CareerCred account. You are solely responsible for keeping your email account secure. Any activity that occurs under your account is your responsibility. If you suspect any unauthorized use of your account, you must notify CareerCred immediately at david@davidweiss.dev. We aren’t liable for any loss or damage arising from your failure to protect your email account.
3. Subscriptions, Payments, and Billing
3.1 Subscription Plan
CareerCred is offered as a single subscription plan that includes full access to the Service — there are no separate feature tiers. New accounts start with a 30-day free trial, and no credit card is required to begin your trial. After your trial ends, you must subscribe to keep using the Service. Pricing may vary depending on when you joined (for example, early-adopter pricing offered to a limited number of early subscribers), but all subscribers get the same features. We may change our pricing at any time, but we’ll give you reasonable notice before any changes affect your current subscription.
3.2 Recurring Billing
By subscribing, you authorize CareerCred to charge your chosen payment method on a monthly recurring basis at the then-current rate for your subscription. Your subscription will automatically renew each month unless you cancel it before the renewal date. We process payments through our third-party payment processor, Stripe, and you agree to abide by Stripe’s terms and conditions as well.
3.3 Payment Information
You must provide valid and current payment information. If your payment method fails, we may suspend or terminate your access to the Service until payment is successfully processed. You are responsible for any applicable taxes, including sales tax, associated with your subscription.
3.4 Cancellations and Refunds
You can cancel your CareerCred subscription at any time from your account settings, which opens Stripe’s secure Customer Portal. Your cancellation will take effect at the end of your current billing period, and you’ll retain access until then. We generally do not offer refunds for partial subscription periods or unused time. All sales are final unless otherwise stated or required by law.
4. User-Generated Content (UGC)
4.1 Your Content
The CareerCred Service allows Users to create and submit content, including the wins you log and any details you add to your account (“User-Generated Content” or “UGC”). Your UGC is private to your account — CareerCred does not publish, display, or share it with other users or the public. You retain all ownership rights in your UGC. We don’t claim ownership over any of your UGC.
4.2 License to CareerCred
By submitting UGC to CareerCred, you grant us a non-exclusive, worldwide, royalty-free license to store, reproduce, and process your UGC — including sending it to service providers such as OpenAI, Supabase, and Resend — solely to operate the Service and provide the outputs you request, such as parsed win entries, post starters, and digest insights. This license lasts as long as you maintain your account or as needed to provide the Service to you, and ends when your content or account is deleted, except where we’re required to retain data (see our Privacy Policy on data retention).
4.3 Content Standards
You are solely responsible for your UGC. You agree not to submit UGC that is illegal, infringing, or otherwise violates the rights of others. CareerCred has the right, but not the obligation, to remove or restrict any UGC that violates these terms, without prior notice.
5. Intellectual Property Rights
5.1 CareerCred's Ownership
All content, features, and functionality of the CareerCred Service, including but not limited to software, text, graphics, logos, icons, images, data compilations, and the arrangement thereof, are the exclusive property of CareerCred, its licensors, or other providers of such material. These are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as generally permitted by the Service’s functionality.
5.2 Trademarks
The CareerCred name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of CareerCred or its affiliates or licensors. You must not use such marks without the prior written permission of CareerCred.
6. AI-Generated Content
The CareerCred Service uses artificial intelligence (via OpenAI) to process the wins you log. This includes parsing the raw text you submit — whether typed into the app or emailed to us — into structured fields like a title, date, relevant skills, and a breakdown of the opportunity, your contribution, and the outcome; drafting post starters based on your wins; and generating thematic insights across your logged wins for digest emails. While we strive for accuracy and relevance, this content is produced by algorithms and may not always be perfect, complete, or up-to-date. It can contain errors, biases, or omissions.
You acknowledge and agree that CareerCred does not guarantee the accuracy, reliability, or completeness of any AI-generated content. You should always review and use your own judgment before relying on or publishing any content generated by our AI features — for example, before building on a suggested post starter or using parsed win details in a resume. CareerCred is not responsible for any decisions you make or actions you take based on AI-generated content from the Service.
7. Third-Party Services
The CareerCred Service relies on the following third-party service providers, none of which are owned or controlled by CareerCred:
- Supabase — authentication and data storage.
- OpenAI — processes your win content to parse it, generate post starters, and produce digest insights.
- Stripe — payment processing and subscription billing.
- Resend — delivers our emails and receives inbound emails sent to our win-capture address.
- PostHog — product analytics.
We provide these integrations to operate the Service, but we don’t endorse or assume responsibility for the content, privacy policies, or practices of any third-party service. When you access a third-party service, you do so at your own risk, and should review its applicable terms and privacy policy. CareerCred will not be liable for any damage or loss caused by or in connection with your use of or reliance on any third-party service.
8. Disclaimers (No Warranties)
The CareerCred Service is provided on an “AS IS” and “AS AVAILABLE” basis. This means we don’t make any promises about its performance or availability. CareerCred expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We also don’t guarantee that the results obtained from the use of the Service will be accurate or reliable, or that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall CareerCred, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
In no event shall the aggregate liability of CareerCred for all claims relating to the Service exceed the greater of one hundred U.S. dollars ($100.00) or the amount you paid CareerCred, if any, in the last twelve (12) months for the Service giving rise to the claim.
10. Indemnification
You agree to defend, indemnify, and hold harmless CareerCred, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (i) your violation of these Terms of Service, (ii) your use of the Service, including, but not limited to, your UGC, (iii) your use of any information obtained from the Service, or (iv) your negligence or willful misconduct.
11. Termination
We may terminate or suspend your account and access to the CareerCred Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service. If we terminate your account, your right to use the Service will immediately cease. If you wish to stop using CareerCred, you may simply discontinue using the Service. If you have an active subscription, cancel it as described in Section 3.4 to stop future billing.
Upon termination, all provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions. This means that Connecticut law will apply to any disputes arising from these terms.
12.2 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the breach, termination, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The arbitration shall take place in the State of Connecticut, United States. The decision of the arbitrator shall be final and binding upon the parties, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
12.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between CareerCred and you individually. To the full extent permitted by law, (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
14. Miscellaneous
14.1 Entire Agreement
These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and CareerCred regarding your use of the Service. They supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
14.2 Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.
14.3 Waiver
No waiver by CareerCred of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of CareerCred to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. CareerCred may assign its rights and obligations under these Terms, in whole or in part, at any time without notice to you.
